Terms of Service

Welcome to STS Connect. These Terms of Service ("Terms") govern your use of the STS Connect platform (the "Service"), operated by Smart Telecom. By creating an account or using the Service, you agree to these Terms.


1. Definitions

  • "Service" refers to the STS Connect unified messaging platform.
  • "You" / "Customer" refers to the business or individual who registers an account.
  • "End User" refers to your customers who contact you via connected channels.
  • "Connected Channels" refers to WhatsApp, Facebook, Instagram, Telegram, Email, and Web Chat.

2. Accounts & Eligibility

You must be at least 18 years old and legally able to enter into contracts to use the Service. You must provide accurate information when registering and keep it updated. You are responsible for maintaining the security of your account credentials and for all activities under your account.

3. Subscriptions, Billing & Refunds

3.1 Plans

The Service offers subscription plans with varying features and limits (Free, Basic, Professional, Enterprise). Plan details and pricing are displayed at stsconnect.chat/#pricing.

3.2 Billing

Paid subscriptions are billed monthly in advance via Stripe. A 30-day free trial is available for new accounts (no credit card required).

3.3 Cancellation & Refunds

You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. All fees are non-refundable. There are no credits or refunds for partially used billing periods.

3.4 Price Changes

We may change pricing with at least 30 days' notice. Existing subscribers keep their current rate until the next renewal.

4. Acceptable Use Policy

You agree not to:

  • Use the Service for unlawful activities, harassment, hate speech, or spam.
  • Send unsolicited marketing or promotional messages without explicit recipient consent (opt-in).
  • Send messages that violate applicable laws, including TCPA, GDPR, CAN-SPAM, or equivalent.
  • Attempt to access, tamper with, or disrupt the Service, its infrastructure, or security.
  • Resell, sublicense, or white-label access to the Service without written permission.
  • Use the Service to send high-volume automated messages that exceed platform limits.
  • Collect or harvest End User data without proper disclosure and consent.

5. Third-Party Platforms & Compliance

The Service integrates with Meta (WhatsApp, Facebook, Instagram), Telegram, and email providers. Your use of these platforms is subject to their respective terms and policies:

We are not responsible for actions taken by third-party platforms, including suspension, restriction, or banning of your accounts on those platforms due to your conduct or content.

6. WhatsApp-Specific Terms

WhatsApp messaging is provided via the WhatsApp Cloud API. By using this feature, you acknowledge that:

  • You must comply with the WhatsApp Business Messaging Policies and Commerce Policy.
  • Message categories (Utility, Authentication, Marketing) and template requirements are defined by Meta.
  • WhatsApp message fees are billed separately by Meta and are your responsibility.
  • We are a Tech Provider, not a BSP, and do not control Meta's pricing or policies.

7. Marketing Messages & Consent

When sending marketing campaigns or promotional messages, you are solely responsible for:

  • Obtaining explicit opt-in consent from recipients before sending marketing content.
  • Providing a clear opt-out mechanism in every marketing message.
  • Honoring opt-out requests within 48 hours.
  • Complying with all applicable anti-spam laws (GDPR, CAN-SPAM, TCPA).

8. Intellectual Property

The Service, including its software, design, branding, and documentation, is the property of Smart Telecom. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. You retain all rights to the content and messages you process through the Service.

9. Data Protection & Privacy

Your use of the Service is also governed by our Privacy Policy. You are responsible for ensuring you have lawful grounds to process End User data shared with the Service.

10. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We are not liable for downtime caused by third-party platforms, infrastructure providers, or force majeure events. We may schedule maintenance with advance notice.

11. Suspension & Termination

We may suspend or terminate your account if you violate these Terms, fail to pay fees, or engage in fraudulent activity. You may delete your account at any time. Upon termination, your data is deleted within 30 days, except billing records retained per legal requirements.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee uninterrupted, error-free, or secure operation.

13. Limitation of Liability

To the maximum extent permitted by law, Smart Telecom shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or business, arising from the use of or inability to use the Service. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold Smart Telecom harmless from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms or third-party rights.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or within the Service. Continued use after changes constitutes acceptance.

16. Governing Law & Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of the United Arab Emirates. The parties irrevocably submit to the exclusive jurisdiction of the Dubai Courts, United Arab Emirates.
